【论文摘要】

鉴于证人证言在刑事案件审理中的重要性,本文试图研究警察询问阶段证人语言的特点,着重于其中衔接手段的使用。证人借助于衔接手段的使用,使证词具有更强的一致性、相关性、逻辑性等,因而提高证词的可信度。本文拟从关联理论的角度出发,根据关联假设及关联原则来分析衔接手段在证人语言中的选择与使用。询问作为证人与警察之间的一种交际是一个明示—推理过程。从证人角度来说是一种明示过程,而根据关联原则,每一个明示的交际行为应设想为本身具有最佳关联性,即同等条件下语境效果越大,付出的努力越小,关联性就越强。在明示过程中证人借助于明示刺激—衔接手段的使用以达到此目的。根据从法院收集的警察询问笔录及本文构建的理论框架,主要解决两个问题:1.证人在证言中是如何选择使用不同的衔接手段以及在这一特定的语境下衔接手段的特点。2.他们如何通过运用这些衔接手段来增强证言的可信度。通过对这两个问题的分析,我们可以得出这样的结论:关联理论可以解释证人语言中衔接手段的选择与使用。因为本文研究的对象是证人语言,因而着重的是从证人角度来探讨明示这一过程。至于他们有意运用的这些语言策略是否达到他们意想的效果,是否有助于减少警...
